AQ Khan The Tainted Nuke Scientist Freed By Pakistani Court

Disgraced nuclear scientist AQ Khan was declared a free man by the Islamabad High Court on Friday, even as media reports suggested that the present Pakistani establishment had come to an out-of-court settlement on easing restrictions imposed on him.

Responding to a petition filed by Khan seeking the further easing of restrictions on him, the Islamabad High Court reiterated its judgement of some months ago that the scientist was a free citizen subject to some security measures.

His house arrest was also abolished. The court also directed the government to provide VVIP security to Dr Khan on an immediate basis. Dr Khan is free now to express his views, interact with the media.

The High Court said Khan, who was accused of running a nuclear proliferation ring, could freely move around within the country and can also visit the Science Foundation for research.

There is also no bar on close friends and relatives meeting him, it said.

However, TV channels reported that Khan had reached some sort of secret, out-of-court agreement with the government on easing restrictions imposed on the scientist after he admitted to running a nuclear proliferation ring in early 2004.

After the judgement, a visibly relieved Khan said, "These things happen. We should forget and look forward."

Khan told reporters that Pakistan President Asif Ali Zardari and former Prime Minister Nawaz Sharif had also been "inside".

"The government had made arrangements and nobody could hurt me. Now also, the government will take care," Khan said.

He also ruled out any vengeance against ex-President Musharraf who had placed him under house arrest saying that Musharraf had been punished by God since now he was out of power.

Khan while ruling out allegiance towards any country other than Pakistan, said that he neither intended to go abroad or enter politics and his thrust would be towards improving the education scenario in his nation.

However, after today’s judgement, only his house arrest has been withdrawn but he has not been acquitted of the charges against him. The case will continue to be tried in the court.

The most serious charge against him was pertaining to him being the kingpin of the network that sold nuclear technology to countries like North Korea, Iran and Libya.

However, after these charges were levelled at him he was sacked from his post and put under house arrest. Musharraf had then rejected calls for his interrogation by other countries saying that Pakistan had good interrogators and questioning by outsiders would undermine the country’s capability.

SEBI allowed to interrogate Satyam’s Raju By Supreme Court

India News : The Supreme Court on Tuesday allowed market regulator SEBI to begin interrogation of Satyam Computers founder Ramalinga Raju and his brother Rama Raju in connection with the over Rs 7,000 crore accounting fraud in the IT company.

The Securities and Exchange Board of India’s (SEBI) investigating officer was granted permission to commence the questioning from tomorrow.

SEBI had yesterday filed a plea through Solicitor General GE Vahanvati and counsel Pratap Venugopal to the bench headed by Chief Justice KG Balakrishnan to interrogate the Raju brothers.

With Raju continuing to elude SEBI even after spending weeks behind bars, the market regulator had moved the SC after the Andhra Pradesh High Court last week deferred to February 9, hearing on its request to quiz the tainted ex-chairman and his brother Rama Raju.

SEBI had moved the High Court challenging a lower court order, which denied it permission to interrogate the Raju brothers, who were arrested by the state police on January 9 — the day a SEBI probe team had summoned them to appear before it in Hyderabad.

In its request to SC, SEBI had said that it was constrained to approach the apex court for urgent relief related to the most serious financial scam that had large-scale national and international ramifications.

The Raju brothers, along with Satyam’s former CFO Vadlamani Srinivas, are now in judicial custody.

A probe team from SEBI had landed in Hyderabad on January 8, a day after Ramalinga Raju disclosed the massive accounting fraud in the IT company.

According to the market regulator, the High Court should have seen that the Raju brothers cannot use judicial custody as a shield to avoid probe by expert agencies.

SEBI further said that just as police apply for custody, any other agency can also apply for access or custody and the same can be granted and the refusal to permit SEBI even to record the statements of the accused while in the custody was “arbitrary, unreasonable and perverse”.

According to SEBI, merely because investigations by different agencies like CID, Enforcement Directorate, Serious Frauds Investigation Office, Registrar of Companies etc may overlap, it cannot be said that they cannot investigate simultaneously pursuant to the power conferred on them under their respective statutes.

Stating that the scam in the NYSE-listed Satyam Computers was the worst in the country’s history, the advocates said that the company’s market capitalisation has fallen from Rs 15,000 crores to Rs 2,000 crores.
